Terms and Conditions – Poelier Ammerlaan

1. Applicability
1.1. These general terms and conditions apply to all offers, orders, purchases, and deliveries of goods and services by Poelier Ammerlaan, located at Aert van der Goesstraat 26 in The Hague (hereinafter: Poelier Ammerlaan).
1.2. By placing an order or making a purchase, the customer agrees to these general terms and conditions.
1.3. Deviations from these terms are only valid if confirmed in writing by Poelier Ammerlaan.
2. Offers and Prices
2.1. All offers and quotations from Poelier Ammerlaan are without obligation and may be changed at any time.
2.2. All prices include VAT, unless stated otherwise.
2.3. Obvious printing or typographical errors in offers, price tags, or publications do not bind Poelier Ammerlaan.
3. Orders and Deliveries
3.1. Orders can be placed in-store, by telephone, or – if applicable – via the website.
3.2. Delivery takes place at the address provided by the customer or in the store, depending on the arrangements made.
3.3. Poelier Ammerlaan reserves the right to refuse orders or to execute them only under certain conditions.
3.4. Delivery times are indicative, and exceeding them does not entitle the customer to compensation or contract termination, unless expressly agreed otherwise.
4. Products and Shelf Life
4.1. Poelier Ammerlaan takes the utmost care to ensure the quality and freshness of its products.
4.2. The customer is responsible for the proper transport, storage, and preparation of fresh products.
4.3. Due to the nature of the products (food), delivered fresh products cannot be returned.
5. Payment
5.1. Payment must be made upon delivery, when collecting in-store, or in accordance with the agreed payment method.
5.2. If payment on account has been agreed, a payment term of 14 days from the invoice date applies, unless otherwise agreed.
5.3. In case of late payment, the customer is in default by operation of law and statutory interest will be charged.
6. Liability
6.1. Poelier Ammerlaan is not liable for damage resulting from improper use, careless handling, or incorrect preparation of products by the customer.
6.2. Poelier Ammerlaan’s liability is in all cases limited to the amount of the relevant order.
6.3. Poelier Ammerlaan is not liable for indirect damage, consequential damage, or loss of profit.
7. Complaints
7.1. Complaints about products or services must be reported to Poelier Ammerlaan as soon as possible, but no later than 24 hours after purchase or delivery.
7.2. If the complaint is justified, Poelier Ammerlaan will, at its discretion, provide a replacement product or (partially) refund the purchase amount.
8. Force Majeure
8.1. In the event of force majeure (such as strikes, fire, pandemic, power outages, transportation issues, or supply problems), Poelier Ammerlaan has the right to suspend its obligations or terminate the agreement without compensation.
9. Privacy
9.1. Customer personal data is handled with care and used exclusively for processing orders and maintaining customer relationships, in accordance with applicable privacy legislation (GDPR).
10. Applicable Law
10.1. All agreements and disputes with Poelier Ammerlaan are governed by Dutch law.
10.2. Disputes will be submitted exclusively to the competent court in The Hague.
